Gabby Petito’s Family Filed a Lawsuit against Brian Laundrie’s Parents

The parents of Gabby Petito filed a lawsuit against the parents of Brian Laundrie. The lawsuit is scheduled for a jury trial in Sarasota County, Florida, in August 2023. However, the attorney for Roberta and Chris Laundrie filed a motion to discharge the civil lawsuit on March 31.

The lawsuit impeaches them of knowingly delivering emotional pressure because their son informed them about the murder. Brian Laundrie informed his parents about the killing of Petito before returning to Florida. However, they suggested not informing Nichole Schmidt and Joseph Petito about their daughter’s killing.

Laundrie’s parents ultimately put attorney Steven Bartolino in advance. He said in his move to discharge the lawsuit that Laundries had a constitutional right not to speak. However, they constantly depended on counsel to speak for them.

The judge allowed 20 Days to file a complaint

It is important that Judge Hunter W. Carroll has allowed 20 days to Petito and Schmidt’s attorneys. They have to file a modified complaint to correct a perceived procedural deficiency in the filed lawsuit. Judge is expected to order the motion of Bartolino.

Judge Carroll said the Court isn’t passing on Defendant’s arguments today. He said it is to be clear that this lawsuit will be discharged with intolerance. Carroll added that the Court’s focus is to address the recognized procedural insufficiency before addressing the evidence of Defendant’s motion.

The attorney for Schmidt and Petito, Pat Reilly, said the modified complaint will declare separate reasons of action against the Laundries on behalf of the Petito family. The court will also decide about the motion to dismiss or not, but it will supposedly consider any merit. The lawsuit will consider damages of around $100K for the mental pain caused by the defiance and meanness of the Laundries.

Brian Laundrie informed his parents about Petito’s Killing

His parents got informed about Gabby Petito’s death from their son on August 28. This lawsuit also blames Laundries for making plans to facilitate Brian Laundrie to escape from the country. It was the time when the parents of Petito were really searching for a word about their daughter.

Gabby Petito and Brian Laundrie were on a cross-county van trip that began earlier in the summer last year. Petito was in close contact with her parents but suddenly stopped communicating near the end of August 2021. However, Laundrie returned to his parent’s home in Florida on September 1.

Laundrie allegedly used Petito’s bank card to pay for his trip home in the van alone. Keep in mind that Petito was reported missing on September 11. Her body was discovered at a remote campsite in Wyoming after 8 days of missing. The initial reports suggested that she died from strangulation.

The Lawsuit is expected to reach a Jury Trial

Meanwhile, Laundrie had left his parent’s home on the 14th of September to go hiking and never returned. The body of Laundrie was discovered in November with an apparently self-inflicted gunshot wound to the head. The attorney of the Petito family, Reilly said Laundrie has top-level confidence. The lawsuit will reach a jury trial if found unsettled out of court.

The attorney of Laundries said the lawsuit also confirms there is evidence to support that the claims are baseless. Reilly also informed them about the evidence and said they will have to wait and see. We shouldn’t have put them in the complaint if we didn’t consider it was true. However, Laundries still haven’t spoken publicly but they continuously said that they didn’t make any wrong decision.
